What the statute actually limits
Section 720.3035(1)(a), 2026 Florida Statutes, says the authority of an association or its architectural committee to approve plans for the location, size, type, or appearance of an improvement, or to enforce external appearance, is permitted only to the extent that authority is specifically stated or reasonably inferred in the declaration or in published guidelines authorized by the declaration. The same paragraph says those standards have to be applied reasonably and equitably to all parcel owners. A driveway color is an appearance question only if the documents reach appearance. A committee preference that is not in those papers is not, by itself, the statute.
Subsection (1)(c) says the association may not require a building permit from a government authority as a prerequisite for the association's own review. That sentence does not cancel the city's permit. It orders the clocks. You can be in front of the committee before the city has issued a permit. You still cannot build in a city that requires a permit just because the committee said yes. Subsection (2) says that if the declaration or the guidelines offer options for material, size, design, or location, the association cannot take those options away. Subsection (3) says that when the documents are silent on setbacks, the county or city setback applies, and the association cannot enforce a conflicting one.
A checklist that stays above any one community
- Find the declaration and the current guidelines. The statute ties the committee's power to those papers.
- Write down the committee's real name. Architectural, design review, and construction committees are not interchangeable labels.
- Ask what the submittal must include: a survey, a sample, a color name, or a drawing. Do not guess the exhibit.
- Submit before a pallet is ordered. A 'reasonable' stock color can still be outside that community's list.
- Keep the city permit on its own track. Do not wait for the city stamp before you are allowed to ask the committee, and do not treat the committee letter as the permit.
- If the documents offer two materials, subsection (2) says you may pick either. If they are silent on a setback, subsection (3) points you to the city or county number.
- Save the written answer. We did not finish a full quote of subsection (4) on denial letters, so this page will not invent the wording of a rejection notice.
- If nobody can find guidelines that mention hardscape, say so in writing and ask the board where the power is stated. Do not assume silence is a ban, or that silence is permission.
Six communities, six pages, no repeated rulebook
This site already published community pages where a public document named both the place and an architectural step. Those pages keep the meeting days, fees, and material sentences we actually read. Copying them here would create a second copy that goes stale. Open the page. Do not ask this checklist to restate it.
| Community | Why it has a page | Open |
|---|---|---|
| LPGA International | Daytona Beach. An association note and a city checklist were read. | LPGA page |
| Spruce Creek Fly-In | County building permits. An ARC packet and later rules were read. | Spruce Creek page |
| Plantation Bay | Master covenants recorded in two counties. One townhome declaration was read, not every section. | Plantation Bay page |
| Venetian Bay | New Smyrna Beach. Design rules dated August 30, 2022 were read. | Venetian Bay page |
| Cypress Head | Port Orange. Driveway guidelines dated August 2022 were read. | Cypress Head page |
| Victoria Park | DeLand. A newsletter and one section's rules were read. Other sections were not. | Victoria Park page |
Places that do not have a page
Latitude Margaritaville, Glen Abbey in DeBary, and Woodhaven do not have community pages. A public architectural process we could read was not found for those three, and a detailed design board for a different Glen Abbey is in Georgia. Hunter's Ridge, Breakaway Trails, and Halifax Plantation are named on the Ormond Beach city page as examples of associations that do not share one palette. We have not published their guidelines. If you live there, use this checklist and the association's own papers. Do not borrow Venetian Bay's color sentences or Victoria Park's fee.
Spruce Creek's page is the one that mixes a county building permit with an association stamp. Plantation Bay's page is the one that crosses the Flagler line. If your parcel might be outside the city a neighbor uses, confirm it before you download that city's driveway checklist. The apron index is the street-strip companion. The permit guide is the city table. Association approval does not pay either of those fees.
What this page will not guess
Last checked November 1, 2026. We did not read subsection (4) of 720.3035 in full, so denial-letter timing is not described here. We did not read every neighborhood's guidelines. We do not file the applications, and we do not claim to have built a driveway in any of these communities. Daytona Pavers is a free matching service. The installer you hire is an independent business.

Questions homeowners ask
Does my HOA have to approve pavers?
Only if the declaration or authorized guidelines give the association that power over appearance, material, or location. Section 720.3035 is the state limit. Your documents are the local answer. Last checked November 1, 2026.
Can the association wait until I have a city permit?
Subsection (1)(c) says the association may not require a government building permit as a prerequisite for its review. The city may still require its own permit before you build.
Where are LPGA, Venetian Bay, and Victoria Park rules?
On their community pages. This checklist links those pages and does not restate the fees or the color lists.
What about Latitude Margaritaville or Glen Abbey?
They do not have pages. We did not find a public architectural process we could cite. Ask the association and keep this statute checklist.
Does association approval replace the apron permit?
No. Street-strip permits are city or county files. Open the apron index and the permit guide after the association step.
Will you submit the architectural application?
No. Daytona Pavers does not file association forms. An installer you hire might help you assemble a drawing. That is between you and that installer.
Request a quote after you have a range in mind
Daytona Pavers is a free service that connects homeowners with local, independent paver installers. It is not itself the contractor. Your request is shared with a local installer so they can contact you with a quote.
Tell us about the project. We pass the request to a local, independent installer. You do not pay Daytona Pavers for the introduction, and you decide whether to hire anyone.
A budget range is optional. It is a planning hint, not a promise. Read how we handle this information on the privacy page.
